Conditions of participation for the TURM raffie on the "https://www.turm4you.de/" website

Preamble

TURM-Sahne GmbH, Westerender Weg 24a, 26125 Oldenburg, Germany, hereinafter referred to as the "Organizer" or "TURM", is organizing a sweepstake on the TURM website https://www.turm4you.de/ in the period from 10.09.2021 to 15.10.2021, 23:59:00. Participation in the sweepstakes and its implementation are governed by the following provisions. By participating in the competition, participants confirm that they agree to these conditions of participation.

Participation

Any person with legal capacity may participate in the competition and, by participating, automatically confirms that they accept the conditions of participation and the data protection provisions. Minors require the consent of their legal guardian to participate. Employees of the organizer as well as their relatives and all persons involved in the competition, in particular those involved in the conception and implementation of the competition, are excluded from participation. Commercial sweepstake companies participating on behalf of third parties are excluded from participation. Each participant can take part once. On the campaign page https://www.turm4you.de/, a user enters the competition by submitting his or her contact details. The contact data will be stored exclusively for the duration of the sweepstake and will not be forwarded to third parties without authorization. Upon expiry of the promotion and the prize draw, all contact data will be deleted.

Closing date

The closing date for entries is 15.10.2021, 23:59:00 German time. Entries received after the closing date will not be considered.

How will the winners be determined?

There will be one winner drawn from all participants.

Winnings/Notification of Winnings

The winner will receive the following prize: - A voucher from Born Originals for a pair of sneakers in individual design. The winning person will be notified by email after the draw. The prize will be sent out within four weeks after the winner has been drawn. In case the provided data of the participant is invalid, TURM is not obliged to find out a correct address or to contact the winning person in any other way. Any disadvantages resulting from the provision of incorrect contact details will be borne solely by the entrant. The prize will also be forfeited if a participant has otherwise provided incorrect information and it is not possible to redeem the prize. In this case, TURM reserves the right to select a new winner. A cash payment of the prize is excluded. The prize is not transferable. TURM is also not liable for a delayed receipt of the voucher by the winner or for a loss of the prize in the post.

Liability

Claims for damages against TURM in connection with the promotion and the prize handed over are excluded, unless TURM has acted intentionally or with gross negligence. The legal liability according to the product liability law as well as in case of injury of life, body and health remains unaffected. Furthermore, TURM is not liable for damages resulting from the impairment of the availability of the conditions of participation at https://www.turm4you.de/ in case of technical malfunctions and events of force majeure which cannot be influenced, as well as malfunctions caused by third parties. However, TURM will do everything in its power to ensure the reliability and operability of the online Conditions of Participation. Furthermore, TURM does not guarantee that the conditions of participation of the prize campaign are properly functioning on the respective participant's computer. All information on the part of the organizer, in particular in connection with the publication of participant names, etc., is provided without guarantee.

Exclusion from the competition

In the event of a breach of these conditions of participation, TURM reserves the right to exclude persons from the competition. Excluded are also persons who use unauthorized aids or otherwise obtain advantages through manipulation. In such cases, prizes may be subsequently disallowed and reclaimed. In this case TURM reserves the right to take legal action. Whoever gives false personal data can be excluded from the competition. The participants concerned will not have any claims against TURM.

Premature termination of the competition

TURM reserves the right to cancel or terminate the competition at any time without prior notice and without giving reasons. TURM will make use of this possibility especially if a proper execution of the game cannot be guaranteed due to technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or due to legal reasons. In case of a termination there is no claim against TURM. If such a termination is caused by the behavior of a participant, TURM can demand from this person to compensate the resulting damage.

Other

The legal process is excluded. The law of the Federal Republic of Germany is exclusively applicable. Should any of these terms and conditions be or become invalid, the validity of the remaining terms and conditions will not be affected. These conditions of participation can be changed by TURM at any time without separate notification.

Complaints

Complaints will only be processed if they are received in writing and mention the competition under discussion at the responsible office gewinnspiel@turm-sahne.de via e-mail or in writing to TURM-Sahne GmbH, Westerender Weg 24a, 26125 Oldenburg. TURM is not willing to participate in a dispute resolution procedure before a consumer arbitration board for the settlement of disputes with participants (consumers).

Data categories and data origin

For participation in the competition, TURM collects and processes the following data: Company name, surname, first name, address, e-mail address, telephone number if applicable. By participating, participants expressly agree to their data being stored by TURM for the duration of the competition and used and utilized for the purpose of processing the prize. Your data will not be forwarded to third parties without authorization for the purpose of processing the competition.

Purpose of processing and legal basis

The personal data of the participants will be processed in compliance with the provisions of the EU General Data Protection Regulation (DSGVO), the Federal Data Protection Act (BDSG) and all other applicable laws. The data is processed exclusively for the purpose of carrying out the competition. The legal basis for this is Art. 6 para. 1 a DSGVO. Participants are free to revoke their consent to the storage at any time by sending a revocation to gewinnspiel@turm-sahne.de and thus withdraw from participation.

Rights of data subjects

Participants are entitled to the following rights according to Art. 15 to Art. 22 DS-GVO if the legal requirements are met: right to information, correction, deletion, restriction of processing and right to data portability.

Right of complaint to the supervisory authority

Participants have the option of submitting a complaint to the above-mentioned data protection officer or to a data protection supervisory authority.

Duration of storage

The data will be deleted after the end of the competition, unless there are legal obligations to retain the data.
